Terms of Service & Refund Policy

These are the terms for using The Grow Program, in plain English. By using the site, requesting a free audit, or buying a plan, you agree to them.
1. Who we are
The Grow Program is operated by Sparta Enterprise LTD, an Israeli company, company no. 514437144, of Mivtsa Harel 14, Ariel, Israel ("we", "us"). We build your audit and deliverables and provide support. Contact: success@thegrowprogram.com.
The service is designed for business use — for owners and operators of ecommerce stores, in connection with their business.
2. Who sells to you
Orders are processed by FastSpring, our merchant of record. That means FastSpring is the seller of record for your purchase: FastSpring runs the checkout, charges your card, collects and remits any sales tax or VAT, and issues your invoice. We never see or store your card details. FastSpring's terms of sale and privacy policy also apply to the purchase transaction — they're linked in the checkout window.
Charges appear on your statement from FastSpring, our authorised reseller, on behalf of Sparta Enterprise LTD. If you don't recognize a charge, email us before disputing it with your bank — almost every issue resolves faster that way.
We — Sparta Enterprise — fulfil the order: we produce and deliver your audit, deliverables, and Growth Plan, and we handle revisions and support.
3. What you're buying
The free audit costs nothing and requires no card. You submit your store's URL and answer a short quiz; we generate an AI marketing audit of your store.
Two paid products, both one-time purchases in US dollars — no subscription, nothing recurring:
- The Grow Bundle — $497. Five deliverables — Messaging, Advertising, Email, Social, and CRO (conversion-rate optimization) — assembled into one Growth Plan document, built from your audit and your intake answers.
- Messaging only — $97. The Messaging deliverable on its own.
Every deliverable is generated with AI and reviewed by a human before release (see §9).
Your purchase is scoped to the one store that was audited — the deliverables are produced for the store URL attached to your audit at the moment of purchase. A different store needs its own audit and purchase.
At launch, the service is offered for sale to customers in the United States.
4. What's not included
So there's no confusion about the $497:
- No implementation. We deliver finished strategy and creative work; putting it live in your store, ad accounts, and email platform is yours to do.
- No ongoing service. This is a one-time deliverable, not a retainer, not account management, not ongoing consulting. Support covers delivery and your revision window.
- No ad spend and no ad management.
- No promise of results. See §8 — every dollar figure is an estimate, not a forecast.
5. Delivery
After purchase you complete a short intake for each deliverable — the work is built from your answers, so delivery timing runs from when you finish intake, not from payment alone. Each deliverable is typically released to your account within 1 business day of completing its intake, and we email you when it's ready. Because a human reviews every deliverable before release, occasionally it takes longer; if we ever expect a material delay, we'll tell you by email.
Delivery happens in your account on www.thegrowprogram.com (passwordless sign-in with the email you used at checkout).
If we fail to deliver a purchased deliverable within 7 days of you completing its intake, you can cancel that purchase for a full refund.
6. Revisions
Each paid deliverable includes one revision. Request it from your account within 14 days of that deliverable's first delivery, telling us specifically what to change. We regenerate the deliverable with your feedback and it goes through human review again before re-release. After the 14-day window, or after your one revision is used, the deliverable is final.
7. Refund policy
Before you buy, you've already seen the actual work: the free audit is a full sample of it, run on your real store, and there's no card required to think it over. Because each deliverable is custom-built for your store and delivered as digital content, our policy is revision-first:
- Not happy with a deliverable? Use your included revision (§6) — tell us what's wrong and we rebuild it.
- Still materially defective after its revision? If a deliverable remains materially defective — factually wrong about your store, incomplete against §3, or unusable for its stated purpose — email us within the 14-day revision window and we'll refund that deliverable (for the Bundle, its proportional share of the price).
- We didn't deliver? Full refund, per §5.
- Changed your mind after delivery? We don't offer change-of-mind refunds once work has been delivered — the free audit and the no-pressure checkout exist so you can decide before paying.
Refunds are requested by email to success@thegrowprogram.com and are processed by FastSpring back to your original payment method.
8. Estimates, benchmarks, and results
Every dollar figure in the free audit, the deliverables, and the Growth Plan — opportunity sizes, projections, break-even numbers, "recoverable" amounts — is an estimate based on the ranges you provided and curated category benchmarks — not guarantees. Results vary by store and execution and are not typical.
- Benchmarks are directional, drawn from published DTC/ecommerce sources and aggregated industry data. They describe typical ranges for a segment, not your store specifically.
- Outcomes depend on things we don't control: your execution, offer, market, and seasonality. Nothing on this site or in a deliverable is a prediction of your earnings.
- The deliverables are marketing analysis and creative work — not financial, legal, or investment advice.
9. How AI is used
Audits and deliverables are generated with large language models and reviewed by a human before release. To produce them, your inputs — your store URL, content we fetch from your public store pages, and your quiz and intake answers — are processed by our AI provider, Anthropic, as a third-party processor. Under the commercial API terms we use, those inputs are not used to train the provider's models.
AI-generated analysis can be wrong. Human review checks every deliverable before release, and the estimates rules in §8 always apply.
10. Your data
What we collect:
- Your store URL and content we fetch from your public store pages
- Your quiz and intake answers
- Your email address, sign-in events, and product-usage events (first-party analytics)
- Order details from FastSpring — product, amount, order ID. Never your card number.
- Support emails you send us
What we use it for: producing your audit and deliverables, delivering and supporting them, transactional email, measuring and improving the funnel, and advertising measurement (§11). We don't sell your data.
How long we keep it: customer data (intake answers, audits, delivered plans, account records) for 24 months after your last delivery; free audits that never become a purchase for 12 months. Then we delete or anonymize. You can request deletion any time at success@thegrowprogram.com and we'll act within 30 days — note that FastSpring retains transaction records independently as merchant of record, and we may keep what the law requires us to keep.

12. Accounts & acceptable use
Sign-in is passwordless: we email a link to the address you used at checkout, so keep that inbox secure and current. You must be 18+ and authorized to act for the business you submit.
You agree not to:
- Submit stores you don't own or aren't authorized to represent
- Use bots, scripts, or bulk submissions against the free audit (bot protection is enforced), or otherwise probe, overload, or interfere with the service
- Resell, rebrand, or offer the service itself (audits, generation, revisions) to third parties — what you may do with your delivered documents is §13
- Use the service for anything unlawful
We can refuse or cancel service for abuse of these rules; if we cancel a paid order for abuse before delivery, we'll refund it.
13. Who owns what
- Your inputs stay yours. You give us permission to process them (including via the providers in §10) to run the service.
- Your deliverables become yours. Once paid in full, the deliverable documents produced for your store are yours to use, edit, and publish for your business, without needing anything further from us.
- The machine stays ours. The methodology, prompts, templates, benchmark data, software, and The Grow Program brand remain ours. Buying a plan doesn't license you to rebuild or resell the service.
- Your name is safe. We won't use your store's name or your results in our marketing without your permission.
- If you send us feedback, we can use it to improve the service.
14. Disclaimers & limits on liability
Apart from what these terms expressly promise (delivery, one revision, the refund rules above), the service is provided as-is, and we disclaim implied warranties to the extent the law allows.
To the extent the law allows: we're not liable for indirect or consequential losses — lost profits, lost revenue, lost data — and our total liability for any claim is capped at the amount you paid us for the product the claim is about (for the free audit, that's $0).
Nothing in these terms takes away rights the law doesn't let us limit — including consumers' statutory rights where they apply.
15. Governing law & disputes
These terms are governed by the laws of the State of Israel, and disputes go to the competent courts of Tel Aviv, Israel — except that if you're a consumer, you keep any mandatory protections and venue rights of the place you live in.
Talk to us first: email us and we'll try to fix it before anyone involves a court.
16. Changes, contact, and the fine print
We may update these terms; we'll post the new version here with a new effective date, and if a change materially affects an order in progress or an open revision window, we'll email you. The version in force when you purchased governs that purchase.
If part of these terms turns out to be unenforceable, the rest still stands. These terms (plus FastSpring's terms of sale for the transaction) are the whole agreement between us about the service. We may transfer this agreement in a sale of the business; you may not transfer it without our consent.
